An employee of the Erdenet Mining Corporation lodged a complaint to the NHRCM that: “The state-owned company is vaccinating all factory workers and their family members over the age of 18 with “Vero Cell” vaccine without any option for alternative vaccine, and if the employee or their family members refuse to get vaccinated, the company threatened that they would not allow to the factory employee to work. Forced vaccination of people without giving regards to their medical condition, such as with allergies, violates our rights." Accordingly, the NHRCM examined the complaint and delivered a Recommendation to the administration of the company on 16 April 2021.
According to the Law on Immunization, there is no legal basis for compulsory vaccination against coronavirus (COVID-19), as such the guidelines and instructions for vaccinating employees and their families may violate the right to health protection of people.
Consequently, to prevent human rights violations, the NHRCM recommended conducting the vaccination against coronavirus (Covid-19) for all factory employees and family members of the plant on a voluntary basis; not vaccinating people with an allergic reaction to any component of the COVID-19 vaccine; following the manufacturer's instructions; and not restricting other rights of unvaccinated employees, such as the right to work.
