NHRCM holds online discussion on “Application of Criminal Legislation during the pandemic”

The NHRCM, the University of Internal Affairs and the Suuriin Jantsan Foundation jointly organized an online discussion on “Application of Criminal Legislation during the pandemic”.

Representatives of the NHRCM, Courts, Prosecutors’ Office, National Police Agency, General Executive Agency for Court Decisions, Mongolian Bar Association, Association of Mongolian Advocates, Mongolian Criminological Society and scholars took part in the online event and discussed human rights violations, challenges and law enforcement during the pandemic.

Representatives of the participating organizations and scholars highlighted following proposals:

- Study possibilities of pardoning and commutation of sentences for target groups;

- Ensure the right of participants in criminal proceedings to receive legal aid and advocates to perform during the pandemic;

- Ensure legal environment for special rules of executing criminal proceedings and investigation during public emergency readiness regime;

- Intensify child protection and domestic violence prevention activities and improve legal environment for witness and victim protection;

- Enable legal environment to conduct judicial hearings online such as probation and early release during the pandemic;

- Pay special attention to the rights of detainees and prisoners, in particular, prevent infection, provide immunosuppressive products and ensure access to medical care and services;

- Promptly take organizational measures to improve working conditions of law enforcement and judicial officers, prevent coronavirus infection and amend relevant laws and regulations on insurance indemnity;

- Efforts to make electronic petitions, complaints, and responses to the courts more efficient and transparent.

The online discussion was of importance as representatives expressed their views on the issues and proposed their suggestions for further actions which will be included in Recommendations to be delivered to relevant authorities.
