Secretariat of the National Human Rights Commission of Mongolia

Under the Law on the National Human Rights Commission of Mongolia, the Commission has a secretariat. The mandate of the National Human Rights Commission came into effect on 2 February 2001 when the Commissioners took their oath of office. The Secretariat of the Commission was established on 20 February, 2001. On the 23rd of January 2020, the Law on National Human Rights Commission of Mongolia was renewed by the Parliament. The rules and regulations of the secretariat are adopted by the Chief Commissioner, and the staff and salary fund are included in the budget approved by the State Great Khural.

The main function of the Secretariat is to ensure the continuous and smooth operation of the Commission and to provide professional and methodological support to the Chief Commissioner and Commissioners in the exercise of their powers.

The Secretariat is headed by the Director, who is appointed by the Chief Commissioner. The Commission has 48 staff members considered as civil administrative servants. The Secretariat has four divisions-Complaints and Inquiry Division, Human Rights Education and Study Division, International Treaty Law and Cooperation Division, and Administration and Management Division.

COMPLAINTS AND INQUIRY DIVISION

The Commissioners shall carry out the following activities within the scope of their main functions to provide professional and methodological support in exercising their authority to investigate complaints and information.

  1. Make proposals and recommendations on any issues related to human rights and freedoms in Mongolia and submit them to the competent authorities, officials, and legal entities;
  2. Conduct scheduled and unscheduled inspections of facilities where human rights and freedoms may be violated within the framework of a memorandum of understanding, agreement and on the grounds, complaints, and information provided by law;
  3. Monitor the implementation of the demands and recommendations delivered in accordance with the complaints and inquiries and take measures to ensure their implementation;
  4. Maintain files of organizations involved in inquiries conducted by the Commission and regularly update information;
  5. Plan and organize activities to protect human rights and freedoms;
  6. Appoint an expert on a particular issue and obtain an opinion;
  7. Monitor the implementation of legislation on gender equality;
  8. Monitor the implementation of the duties of state organizations and officials to ensure, protect and respect human rights within the scope of their powers granted by this law and other laws;
  9. Participate in the preparation of the human rights status report and freedoms in Mongolia and its submission to the parliament;
  10. Receive complaints and information on violations of human rights and freedoms, resolve and respond within the timeframe specified by law;
  11. Analyze the issues raised in the petitions and complaints submitted to the Commission and use them as a source of information;
  12. Provide citizens with legal advice;
  13. Be in charge of filing a lawsuit in court and compiling evidence;
  14. Conduct mediation;
  15. Cooperate with relevant agencies and exchange information on a regular basis to improve the system of restoring violated rights.
  16. Provide technical and methodological support and exchange information to members and units in charge of torture prevention, if necessary.

HUMAN RIGHTS EDUCATION AND STUDY DIVISION

In Article 13.2.5 of the Law on the National Human Rights Commission of Mongolia, it is stated, "The Commission, in its full power, shall support activities to provide human rights education.”

The Human Rights Education Division caries out activities to provide human rights education, to raise awareness of human rights, and to develop a culture of ensuring and protecting human rights, training, promotion, and advocacy.

In this scope, the division carries out the activities as follows:

  1. Conduct research on necessary issues by research issues by research organizations and non-profit legal entities;
  2. Analyze and make recommendations on legislative and administrative decision from a human rights perspective;
  3. Obtain information from various sources and establish a database on human rights research to assess the human rights situation;
  4. Analyze the implementation of legislation on gender equality;
  5. Participate in the preparation of a report on the situation of human rights and freedoms in Mongolia and submit it to the parliament;
  6. Monitor the implementation of the resolutions of the parliament and the Standing Committee of the parliament issued in accordance with the report
  7. Carry out activities aimed at improving the content, methodology, quality and accessibility of human rights education provided in the formal education system;
  8. Support and organize the dissemination of human rights education to improve the content, methodologies, quality, and accessibility of human rights education;
  9. Conduct human rights training for the target groups included in the Commission’s long-term plan;
  10. Organize various types of forms of human rights advocacy and evaluate the results;
  11. Promote, encourage and cooperate in promoting and disseminating human rights issues to the public, and cooperate with the media on human rights issues;
  12. Organize activities to develop theoretical and practical research on human rights;

INTERNATIONAL TREATY LAW AND COOPERATION DIVISION

Under the Commission’s functions to put forward proposals to ratify and/or accede the international human rights treaties and send submission to the United Nations Human Rights Council and treaty bodies and to develop multilateral cooperation, the Division will implement the following activities:

  1. Conduct analysis on needs and significance of ratifying and/or acceding the international human rights treaties;
  2. Carry out advocacy and lobbying activities aimed at encouraging the State to ratify and/or accede the international human rights treaties;
  3. Provide technical support and collaborate with the Government of Mongolia to fulfill its obligations under international human rights treaties;
  4. Provide its proposals to the Government report on implementation of international human rights treaties, and produce and send a parallel report to the international human rights treaties when necessary;
  5. Carry out activities aimed at implementing recommendations of the Universal Periodic Review by the UN Human Rights Council, UN treaty Committees and of Special Rapporteurs provided to the Government of Mongolia after consideration of its reports;
  6. Carry out activities aimed at drafting national laws, policies and programs in compliance with the UN human rights treaties and conventions, redressing human rights violations, doing strategic litigation and building a national capacity for submitting individual communications to the UN treaty bodies;
  7. Carry out advocacy and public awareness raising activities about international human rights treaties and conventions;
  8. Actively and consistently collaborate with legislative, executive and judicial bodies in order to oversee the implementation of human rights and to protect and promote human rights;
  9. Collaborate with civil society and private entities;
  10. Ensure the implementation of rules of the Advisory Board Council of the Commission and provide assistance to the operation of the Council;
  11. Subscribe to membership of any international cooperation agencies and networks in compliance with functions of the Commission and actively participate in their events as a member;
  12. Expand the partnership, cooperation and share practices with UN bodies, regional and international NHRIs;
  13. Collaborate with the state, civil society, legal bodies, international organizations, embassies and development agencies on human rights field and develop multilateral cooperation;
  14. Participate in drafting and submitting a report on situation of human rights and freedoms in Mongolia.

ADMINISTRATION AND MANAGEMENT DIVISION

This division supports the Chief Commissioner and other Commissioners with policy of multilateral cooperation and conducts operations to publicize daily activities of the Commission at the national, regional and international levels.

In addition, the division functions to connect the activities of the Commission with the activities of other human rights organizations, both government and non-government, operating at the national, regional and international levels, to cooperate with those organizations for the mutual benefit of all.

It also helps to coordinate and liaise the internal regular functions of the Commission, provides the Commissioners with professional and methodological assistance.

Other functions of the division are to carry out the archival and documentation process according to laws and relevant rules and to provide the Commissioners and the staff with technical assistance in fulfilling their duties.

The division also develops the Commission’s action policy and ensures the annual budget is spent efficiently and effectively.
